BIRTH REGISTRATION

 

A new born baby can be registered as a Malaysian Citizen at this office on the following conditions:

§         Father of the child is a Malaysian Citizen

§         Registration is made within one (1) year from the date of birth

 

REQUIREMENTS:

 

  • Baby’s passport-sized photographs (2 pcs)

            3.5 cm X 5 cm

 

  • Baby’s birth certificate (bring original and 2 photocopies)
  • Both Parents' passport (bring original and 2 photocopies)
  • Both Parents' Identity Card (bring original and 2 photocopies)
  • Both Parents' Birth Certificate (bring original and 2 photocopies)
  • Both Parents' Marriage Certificate issued by Malaysian Government (bring original and 2 photocopies)
  • Applicant has to fill in “Borang ‘D’” which is provided by the Consulate
  • The fee is HK$ 62.00

 

NOTE:

 

Father and baby are required to be at the Consulate for the application purpose.

 

The registration has to be made within 1 year from the date of birth. For late registration, it will be referred to the National Registration Department of Malaysia for approval. For this case, the Consulate has no authority to issue Borang W (Birth Certificate). After approval is received, the Consulate will notifiy the applicant.

 

Birth Certificate of Mother with English Language Translation must endorsed (authenticated) by the Consulate of the relevant country in Hong Kong SAR (if Mother is not a Malaysian)

 

 

CITIZENSHIP APPLICATION (For Mother is Malaysian and Father is a Foreigner)

 

 

NEW - ARTICLE 15(2)  OF FEDERAL CONSITUTION STATES A MALAYSIAN MOTHER CAN REGISTER HER CHILD TO BE A MALAYSIAN CITIZEN WITHIN ONE (1) YEAR OF THE DATE OF BIRTH.

 

REQUIREMENTS:

 

  • Baby’s passport-sized photographs (3 pcs)

  • Baby’s birth certificate (bring original and 2 photocopies)
  • Baby's passport (if any, bring original and 2 photocopies)
  • Both Parents' passport (bring original and 2 photocopies)
  • Both Parents' Identity Card (bring original and 2 photocopies)
  • Both Parents' Birth Certificate (bring original and 2 photocopies)
  • Both Parents' Marriage Certificate issued by Malaysian Government (bring original and 2 photocopies)
  • Applicant has to fill in: 

           i. Form 'B'

           ii. Lampiran A.15(2)

           iii. Lampiran A-W

 

The fee is HK$ 62.00

 

NOTE:

 

Mother, Father and baby are required to be at the Consulate for the application purpose.

 

The registration has to be made within 1 year from the date of birth. Mother is a Malaysian at the time of child's birth and the child is legible. This application is only apply for those who born on 01.01.2010 and after. For late registration, it will be referred to the National Registration Department of Malaysia for approval. For this case, the Consulate has no authority to issue Borang G (Birth Certificate). After approval is received, the Consulate will notifiy the applicant.

 

 

MARRIAGE REGISTRATION (for Non-Muslim Marriage only)

 

Under (Marriage and Divorce Act 1976 of Malaysia)

 

Marriage can be registered at the Malaysian Mission if at least one of the couple is a Malaysian citizen.

Non-Muslim citizens who are married in Hong Kong MUST register the marriage with this office within the period of six (6) months from the date of marriage. This is a legal requirement and for the marriage to be legally recognized in Malaysia.

 

REQUIREMENTS:

  • Marriage Certificate already certified by Ministry of Home Affairs / District Office in Hong Kong SAR (bring original and 2 photocopies)
  • Passport of husband and wife (bring original and 2 photocopies)
  • Identity card of husband and wife (bring original and 2 photocopies)
  • Birth Certificate of the Foreign Spouse with English Language Translation and endorsed (authenticated) by the respective Consulate in Hong Kong SAR (bring original and 2 photocopies)
  • Passport-sized photo of husband and wife (2 each)

·           For divorcee, please bring along the Divorce Decree (bring original and 2 photocopies)

  • Single Status Certificate from National Registration Department of Malaysia is required for Malaysians for registration of Marriage abroad (bring original and 2 photocopies)

  • The fee is HKD42.00

 

NOTE:

 

The form is provided by the Consulate

 

Husband and wife must come together in person for signing of documents.(Borang KC06 and KC07)

 

Those who were married outside Hong Kong and wish to register their marriage with the Consulate General of Malaysia in the Hong Kong SAR, they should get their marriage certificate endorsed (authenticated) by the Consulate of the relevant country in Hong Kong SAR.

 

If over 6 months period, there will be a penalty charge of HK$ 200.00 for the first year (one day late is considered 1 year penalty). For each subsequent year, the penalty will be HK$ 100.00 a year or part thereof.

 

For the marriage ceremony of Muslim couples (where one/both of the couple is a Malaysian citizen), it needs to be registered at the religious office in respective states once back in Malaysia. The Consulate will issue a confirmation letter to certify the marriage of the couple based on the marriage certificate issued by Hong Kong Government.
