REGISTRATION OF MARRIAGE

 

Application can be submitted at National Registration Department or at the Embassy for re-registration of marriage for non-Muslims Malaysian, whose marriage was registered under the laws of a foreign country, so that it will be legally recognized in Malaysia.

 

The re-registration does not apply to the non-citizen who was granted a Malaysian citizenship status after his or her marriage was registered under the laws of a foreign country.

 

Application Requirements:                                                                                                         

 (a) The couple are required to be present at the Embassy for the application and registration of marriage; and

        (b) A marriage registered under the laws of a foreign country must be re-registered at the Malaysian Representative Office within 6 months of the date of marriage. If the couple enter Malaysia before the expired 6 months of the date where the marriage was registered under the laws of a foreign country then the calculation of 6 months will commence on the latest arrival date in Malaysia dictated in the passport. Re-registration after 6 months will incur a PENALTY under Section 35, Act 164: “Any person who, being required by section 31 to appear before a Registrar, omits to do so within the prescribed time shall, on conviction, be liable to imprisonment for a term not exceeding one year or to a fine not exceeding one thousand ringgit or to both.”

 

Required Documents:

(a)          Form JPN.KC06 that is completed (available at the Embassy);

(b)          Original MyKad (Malaysian citizen);

(c)          Original passport and photocopy of page with personal details;

(d)          Original passport and photocopy of page with personal details and date in the passport during which the marriage was registered in the pertinent country for Malaysian and non-citizen;

(e)          Identity Document used for marriage registration in the foreign country for non-citizen, if applicable;

(f)           One (1) color passport-sized photograph per applicant;

(g)          Foreign marriage certificate (original and photocopy);

(h)          Birth Certificate for non-citizen (original and photocopy);

(i)            Decree nisi absolute (divorce certificate), if applicable (original and photocopy);

(j)            Death certificate of previous spouse, if applicable (original and photocopy); and

(k)          Please note that all the documents must be original in Malay or English otherwise you must include an original Malay or English translation by a qualified translator. The translation must include name, signature contact details of translator and date of translation.

REGISTRATION OF CHILDREN BORN IN CZECH REPUBLIC

 

Children born in the Czech Republic, whose father at the time of birth is a Malaysian citizen can apply for Malaysian Citizenship under Article 14 of the Federal Constitution – Confirmation of Citizenship (Born outside Malaysia).

 

Application Conditions:

 

(a)          The applicant and the person to be registered shall appear before the Registrar of

Citizenship/consular officer when submitting the application in accordance with Rule 28 of the Citizenship Rules 1964 (Amendment 1996);

            (b)           The applicant shall be the parent, guardian or next of kin; and

            (c)           Form D (available at the Embassy) must be completed and submitted together with copies

  of the necessary documents.

Registrant’s Documents (Originals and Copies)

             (a)          Birth Certificate or latest extract of Birth Certificate (translated into Malay or English by the

public translator);

             (b)          Entry permit or passport or other travel document; and

             (c)          Three (3) recent passport-sized photographs with a blue background

 

Parents’ Documents (Originals and Copies)

             (a)          Birth Certificate or latest extract of Birth Certificate;

             (b)          Identity card (if any);

             (c)          Passport or other travel document;

             (d)          Citizenship Certificate; and

             (e)          Marriage document.
